Judge Rejects Compass Bid to Block Zillow’s Private Listing Ban

A federal judge just gave Compass an early setback in its high-profile antitrust fight with Zillow, clearing the way for Zillow to keep enforcing its private listing ban while the case moves forward.

In a February 6 ruling, the court denied Compass’s preliminary injunction that would have paused Zillow’s listing access standards. The judge noted that Compass didn’t have enough evidence to show real competitive harm, credible evidence of collusion, or a strong likelihood of winning its monopoly claims. 

For now, Zillow’s policy stays in place, and Compass’s broader lawsuit continues on a much steeper legal hill.

The decision lands in the middle of a growing industry fight over private listings, MLS exposure, and who ultimately controls how homes reach buyers online. 

It also offers the clearest signal yet about how skeptical the court may be of Compass’s core arguments as the case unfolds.

In response to the court’s decision, Compass CEO Robert Reffkin gave the following statement: 

“Today’s decision is not a loss, and our lawsuit continues forward. In Zillow’s internal strategy document, Zillow said Zillow will ‘punish the agent for choosing to put their listings on alternative networks.’ 

“With agents being our clients, we have an obligation to protect our agents from Zillow, which explicitly stated they are trying to ‘punish the agent’.”

The Court Found No Evidence of Collusion or Monopoly Power

The heart of the ruling came down to evidence, or more accurately, the lack of it.

U.S. District Judge Jeannette Vargas made it clear that Compass hadn’t met the legal standard required to freeze Zillow’s policy while the lawsuit plays out. 

Compass has not shown a likelihood of success on the merits,” Vargas wrote in her decision, cutting straight to the standard that governs emergency injunctions.

The court found no proof that Zillow had entered into any anticompetitive agreement with Redfin, brushing aside claims of a behind-the-scenes conspiracy as speculative.

The judge was equally unconvinced by Compass’s monopoly argument. Even with estimates suggesting Zillow controls as much as 50% to 66% of the online listings market, Vargas noted that brokers still have plenty of other ways to market homes and reach buyers. 

Brand recognition alone, she wrote, doesn’t amount to illegal market control.

From Zillow’s perspective, the ruling was a validation of its transparency stance.

“Today’s decision is a clear victory for the company, home buyers and brokers,” Zillow said in a statement following the ruling.

The overall message from the court: sweeping antitrust accusations require hard proof. At this early stage, Compass didn’t have it.

Why Zillow’s Private Listing Ban Survived the Injunction Challenge

With the injunction denied, Zillow’s listing access standards remain fully in force, and the court made clear it saw no urgent reason to step in.

The policy, announced in April and enforced beginning in late June, blocks listings that have been publicly marketed for more than one business day before being broadly distributed through MLS-powered IDX or VOW feeds. Compass argued the rule was designed to pressure agents away from alternative listing networks and funnel inventory back onto Zillow’s platform.

The judge didn’t weigh in on whether Zillow’s policy is good or bad for the industry long term. What mattered for the injunction was that Compass failed to show the rule was illegally suppressing competition or causing the kind of immediate, irreparable harm that would justify court intervention.

For now, that means Zillow can continue enforcing the ban while the broader antitrust case works its way through the legal system.

How the Private Listing Debate Set the Stage for This Legal Fight

Compass has promoted exclusive listings through its 3-Phase Marketing Strategy, which encourages sellers to list privately for a testing period before entering the MLS. 

The conflict between Compass and Zillow intensified after the National Association of REALTORS® updated its Clear Cooperation Policy to allow limited pre-marketing. 

One month later, Zillow announced its stricter rules governing private listings. 

Compass promotes private listings as an option that expands seller choice, but critics argue they fragment the market and limit transparency, reducing available (for-sale) inventory that’s visible to today’s buyers. 

In a statement to Reuters, Zillow cited buyer frustration with today’s market conditions as further reason for enforcing listing transparency. 

“At a time when Americans are struggling to afford a home amid a major housing shortage, hiding listings in private networks only deepens the crisis.”
